Process for granting US immigration visa under EB-3 work status

Applicants for an EB3 visa must be employed by a US company and the applicant/employee must receive an invitation letter from the US company. The US company will then apply for a Labor Certificate (Program Electronic Review Management – PERM/LC) for EB3 visa workers to the US Department of Labor. PERM, also known as PERM Labor Certification, is a work permit for employers in the US to recruit workers from abroad. Sometimes this license is referred to as LC.

To be granted PERM, recruitment companies in the US must prove to the US Department of Labor that throughout their recruitment process, they have applied measures to look for US citizen candidates to fit the position but were unable to find anyone who was qualified or wanted to apply. Subsequent PERM Labor Certification approval from the Department of Labor (DOL) means that the position for which this employer is filling CANNOT FIND DOMESTIC WORKERS AND MUST HIRE IMMIGRANT WORKERS.

Once there is a Labor Certificate, the US company will submit the application to the US Immigration Department. Current processing time is from 9.5 months to 12.5 months (California Service Center). The US Immigration Department applies an expedited application processing process within 15 days.
